§1 Scope of application, definition

These terms and conditions apply to all orders placed with KNX Tutorial by consumers or companies via the Internet pages or in any other form. In transactions with businesses, these terms will be included for the current business relationship with the first order.

A consumer is any natural person who concludes a legal transaction for a purpose that cannot be attributed to either his commercial or his self-employed professional activity. Businesses are a natural or legal person or a partnership with legal capacity which, when concluding a legal transaction, acts in the exercise of its commercial or independent professional activity; a partnership with legal capacity is a partnership which is endowed with the ability to acquire rights and enter into liabilities.

§2 Conclusion of contract

The presentation of the products on our website and in the shop is not a binding offer, but a non-binding product presentation. For an order in the webshop the orderer must:

1) select an article for purchase; 2) enter personal data (name, e-mail address, billing address if applicable); 3) select payment method; 4) confirm the accuracy of his information 5) at the end click on the button “buy” and pay.

By clicking the button “buy” and paying for the goods, the customer places a binding order for the goods contained in the shopping cart. The order represents an offer to KNX Tutorial to conclude a contract. After receipt of payment an order confirmation as well as an invoice will be sent to the e-mail address given in the order process. The issuance of the invoice is the acceptance of the offer by KNX Tutorial.

§3 Prices and shipping costs

The prices indicated are final prices including the applicable statutory value added tax of (currently) 19 %. Accidental misprints are possible; in case of doubt, the binding price is not the price indicated on the website or in any other form, but the price confirmed in KNX Tutorial’s declaration of acceptance.

§ 4 Payment, due date and delivery

The purchase price for the goods and their shipment is due immediately upon conclusion of the contract and must be paid by credit card (Mastercard, Visa), Paypal, Paydirekt, iDeal or Sofortüberweisung.

By stating the credit card number/account number in the order, KNX Tutorial is authorised to collect the purchase price amount from the credit card account/current account stated by the customer in the order upon conclusion of the contract; any bank charges resulting from failure of the money order due to underfunding of the account must be borne by the customer. In the event of approval of the direct debit procedure, the money shall be debited by us after delivery and invoicing.

The payment obligation becomes due at the latest when the goods are handed over to the customer.

Delivery will be made to the e-mail address provided by the customer.

§5 Right of revocation for consumer contracts

As we are convinced of our product, we grant a 30-day money-back guarantuee on a voluntary basis. You therefore have the right to revoke within thirty days without giving reasons, starting from the day of the order.

To exercise your right of withdrawal, you must contact us, KNX Tutorial, Hochkamp 6a, 21244 Buchholz in der Nordheide, represented by Christian Szczensny, E-Mail: info@knxtutorial.com, URL:http://www.knxtutorial.com and inform us of your decision to revoke this Agreement by means of a clear statement by e-mail. In addition, you must delete all data received from us (in particular the data of the KNX Tutorial ebook) from all your computers and confirm this to us in your revocation.

In order to comply with the revocation period, it is sufficient for you to send notice of the exercise of the right of revocation before the expiry of the revocation period.

If you revoke this contract, we shall reimburse you for all payments we have received from you without delay and at the latest within fourteen days of the day on which we received notification of your revocation of this contract. We will use the same means of payment for this refund as you used for the original transaction, unless expressly agreed otherwise with you; in no event will you be charged for this refund.

§6 Warranty, Security and Copyright

All information provided by KNX Tutorial has been compiled to the best of the authors’ and publishers’ knowledge. Nevertheless, errors cannot be completely excluded. Therefore, the information is not associated with any obligation or guarantee of any kind. As a result, the authors and publishers do not assume any legal responsibility and will not assume any resulting or other liability that may arise in any way from the use of this information, including for the infringement of patent rights and other rights of third parties that may result from it.

Similarly, authors and publishers do not guarantee that the procedures described etc. are free of third party industrial property rights. The reproduction of common names, trade names, product designations etc. in this work, even without special marking, does not entitle the user to assume that such names are to be regarded as free in the sense of trademark and brand protection legislation and may therefore be used by anyone. This work including all its parts is protected by copyright. Any use outside the narrow limits of copyright law without the consent of the publisher is prohibited and punishable by law. This applies in particular to reproduction, translation, microfilming and storage and processing in electronic systems. The printing of PDF files for personal use is explicitly permitted.

Electrical installation is a dangerous trade for which training, suitability and approval are required. Corresponding legal regulations must be observed.

§7 Use of data

All personal data is kept strictly confidential at KNX Tutorial. Our data protection practice is in particular in accordance with the DSGVO, the Federal Data Protection Act (BDSG new) and the Telemedia Act (TMG). Personal customer data will only be passed on to third parties for the processing of orders. Only the necessary data will be passed on to the service provider. Among other things, it is possible at any time to request information free of charge about the data stored on one’s own person and to have this data deleted, corrected or blocked for advertising purposes. §8 Miscellaneous

All contracts concluded with KNX Tutorial within the meaning of § 1 are subject exclusively to the law of the Federal Republic of Germany with the express exclusion of the United Nations Convention on Contracts for the International Sale of Goods; if the customer is a consumer and is not domiciled in Germany, mandatory provisions of the country in which the consumer is domiciled shall remain unaffected by this choice of law. In such cases, the law of the country in which the consumer is domiciled shall apply in favour of the consumer. The contract language is German.

The place of jurisdiction for all present and future claims arising from the business relationship with businesses is the registered office of KNX Tutorial; the same applies to consumers if the purchaser does not have a general place of jurisdiction in Germany, relocates his place of residence or habitual abode outside Germany after conclusion of the contract or if his place of residence or habitual abode is not known at the time the action is filed.

In business transactions with companies, the joint place of performance of the parties is the registered office of KNX Tutorial.

If the purchaser is an entrepreneur, the inclusion of his general terms and conditions is contradicted; in the event of dissent in individual parts, the entire contract shall be deemed not to have been concluded (§ 139 BGB).

Notifications and declarations to KNX Tutorial must be made in text form. Contractual agreements or declarations of the user remain unaffected by this provision.

Should any of the above conditions not be effective, this shall not affect the validity of the remaining provisions.
